Can an employer dock your salary pay for missing hours due to an emergency?
So Last Monday I brought my girlfriend to an ultra sound for our baby because they thought she might not be growing anymore. They ended up telling us we needed to stay because they wanted to induce her that night and put her into labor the next day. I immediately called my brother (Who is the assistant manager at my work) excited about having my little girl 2 weeks early. I told him i would be out the next few days and told him what needed to be done while i was gone. Everything ran smoothly and all work was completed perfectly. While I was in the hosiptal the day she was in labor the owner (My employer) sent me text’s asking when I would be back in. I wrote back Not sure because the baby was not born yet, But if everything go’s fine 2 days ( Beginning of next pay week. Because of this I lost 2 days of the end of the last week of pay. ( We get paid every 2 weeks, So in the 10 day work week, I did 8 days and 71hours of the 90hour salary week) so the owner contacts me and tells me she is docking my pay because I "did not complete my duty’s as manager" and was out for 2 days "Without reasonable notice" I said to her that my baby came early and under the circumstance I had no way of giving notice because it happened before it was planned. I also explained that everything was running perfect and my brother was taking care of everything for the few days I was gone. She then said "well unless you want to use your vacation time, I will be docking your pay for the missed ours. I thought this was very unfair but had no choice because I need as much cash as I can get at the moment with A new baby coming into the world so I told her if i had no choice to use my vacation time. My brother and worker called later to tell me the owner and her father were saying things like "We need to teach him a lesson and doc his pay, he can’t just leave work for 2 days and think he is getting paid for it" and also said she thought I was in poor taste to have a child at my age (23yrs). Both my brother and 1 worker heard all of this and were angered along with myself. It seems both unfair and unprofessional for my employer to do this. So I am trying to figure out if was legal for them to doc my pay for the missed hours with little to no notice and tell me I had to use my vacation time if i wanted the full salary amount? Why should your employer pay you for time you are not at work? I consider that totally reasonable on their part.
It’s not your employer’s job to pay you for family emergencies.
Be happy that your daughter is healthy, and move on.

Yes, unless it is specifically outlined in the employee hand book that you will not be docked if you have enough time accrued.
If the time you have accrued is vacation, then you must use that.
Why do you feel that your employer owes you any money for time that you were unproductive for him?

My employer would allow me to take the time as vacation time or it would have to be unpaid. If your employer said you could take vacation time for the missed work time then I would take it!
